Terms and Conditions of Use
1. Service Provider Identification
In compliance with Article 10 of Spanish Law 34/2002 of July 11 on Information Society Services and Electronic Commerce (LSSI-CE), the following information about the service provider is disclosed:

2. Purpose
Artifex (hereinafter referred to as the “Platform”) is a mobile intermediation application that connects artisans and sellers with buyers interested in handcrafted and custom products.
The Platform is not a party to any commercial transactions between sellers and buyers. Artifex does not process payments, does not set prices, does not manage shipping, and does not store products. Its sole function is to facilitate communication and product discovery between the parties.
Use of the Platform constitutes full and unreserved acceptance of these Terms and Conditions. If you do not agree with any of them, please refrain from using the Platform.
3. Definitions
- Platform: The Artifex mobile application, available for Android and iOS devices, including all its content, features, and services.
- Artisan / Seller: A registered user who publishes handcrafted or custom products for sale through the Platform.
- Buyer / Customer: A registered user who browses, inquires about, and places orders for products offered by sellers.
- Order: A formal purchase request made by a buyer to a seller through the Platform.
- Custom Product: An item crafted or modified according to the buyer’s particular specifications.
- Enchantment: A Platform feature that allows sellers to highlight or promote their products within the catalogue.
4. Registration and Accounts
To access the full functionality of the Platform, users must register by creating a personal account.
- Registration is restricted to individuals aged 18 or older, or who otherwise have the legal capacity to enter into contracts.
- There are two types of accounts: CUSTOMER (buyer) and SELLER (artisan/seller). A single user may hold both roles.
- Users agree to provide truthful, complete, and up-to-date information at registration and to keep it current.
- Each user is responsible for maintaining the confidentiality of their login credentials and for all activity that occurs under their account.
- If unauthorised use of an account is suspected, the user must notify the service provider immediately at dalodev.dev@gmail.com.
5. Seller Plans
The Platform offers the following plans for users with a seller role:

PRO subscriptions are managed through the Google Play Store (Android) or the Apple App Store (iOS). The refund, renewal, and cancellation policies of the respective app stores apply to subscriptions purchased through those platforms.
In the event of cancellation or expiration of the PRO subscription, published products exceeding the free plan limit (3 products) will be automatically archived. The 3 most recent products will remain published. Archived products can be republished by renewing the PRO subscription. Artifex will notify the Seller via push notification when product archival occurs.
The service provider reserves the right to modify plans, pricing, and conditions. Any changes will be communicated to users with the advance notice specified in Section 17 of these Terms.
6. Platform Operation
The Platform allows sellers to:
- List handcrafted or custom products with descriptions, images, prices, and terms of sale.
- Manage their product catalogue and receive order requests from buyers.
- Communicate with buyers through the Platform’s internal messaging tools.
The Platform allows buyers to:
- Browse the catalogue of products and registered sellers.
- Submit order requests to sellers.
- Contact sellers to inquire about product details.
The Platform does not guarantee the availability of any product, nor the acceptance of any order by a seller.
7. Order Process
The order process on Artifex follows these stages:
- Creation: The buyer submits an order request to the seller, specifying the desired product and, where applicable, customisation details.
- Acceptance or rejection: The seller reviews the request and decides whether to accept or reject it. Sellers are under no obligation to accept any order.
- Order statuses: Orders progress through various statuses (pending, accepted, in production, shipped, completed, cancelled) which are displayed on the Platform for both parties’ reference.
- Payment: Payment is made outside the Platform, directly between buyer and seller, through whatever means both parties agree upon.
Important: Artifex does not participate in the payment process. Payment terms, deadlines, and methods are the sole responsibility of the parties involved in the transaction.
8. Payment Liability Disclaimer
Artifex does not process, manage, or intermediate any payments between buyers and sellers. The Platform does not collect banking or credit card details from users in connection with transactions between parties.
Consequently, the service provider is exempt from all liability arising from:
- Non-payment, late payment, or partial payment between the parties.
- Fraud, scams, or irregularities in the payment methods used by the parties.
- Financial disputes between buyer and seller arising from the transaction.
- Any tax or fiscal obligations arising from transactions conducted between the parties.
9. Seller Responsibilities
Sellers agree to:
- Publish truthful, accurate, and non-misleading information about their products, including descriptions, images, and prices.
- Comply with all applicable regulations, including consumer protection, tax, health, and product safety legislation.
- Manage orders received in good faith, responding within a reasonable timeframe and keeping the buyer informed of the order status.
- Ensure that the products offered do not infringe on any third party’s intellectual or industrial property rights.
- Fulfil all tax and fiscal obligations arising from their commercial activity, including issuing invoices where required under applicable law.
- Respect consumer rights under Royal Legislative Decree 1/2007 (LGDCU) and complementary regulations.
10. Buyer Responsibilities
Buyers agree to:
- Provide truthful information when placing order requests, including customisation specifications.
- Act in good faith in negotiations and transactions with sellers.
- Honour the payment agreements reached with the seller.
- Refrain from placing fraudulent, speculative, or insincere order requests.
- Communicate with sellers in a respectful and professional manner.
11. Custom Products and Right of Withdrawal
Pursuant to Article 103(c) of Royal Legislative Decree 1/2007 (LGDCU), the right of withdrawal shall not apply to contracts for the supply of goods made to the consumer’s specifications or clearly personalised.
Given that a substantial portion of the products offered through Artifex are handcrafted and custom-made, buyers should be aware that:
- Products made to order or customised are not subject to the right of withdrawal under applicable law.
- Before confirming an order for a custom product, the buyer must ensure that the specifications provided are correct and complete.
- For products that are not custom-made, the general withdrawal regime under the LGDCU shall apply, although the contractual relationship is exclusively between buyer and seller, without any involvement of the Platform.
12. Intellectual and Industrial Property
All Platform content (design, code, logos, trademarks, text, graphics, and interface) is owned by the service provider or used under licence, and is protected by Spanish and international intellectual and industrial property law.
Sellers retain intellectual property rights over the content they publish (photographs, descriptions, product designs). By publishing on the Platform, they grant the service provider a non-exclusive, royalty-free, and revocable licence to display, reproduce, and distribute such content within the scope of the Platform’s operation and promotion.
The reproduction, distribution, public communication, or transformation of any Platform content without the express authorisation of the rights holder is prohibited.
13. Prohibited Conduct
The following uses of the Platform are expressly prohibited:
- Publishing illegal, offensive, defamatory, discriminatory content, or content that violates the fundamental rights of third parties.
- Selling illegal, counterfeit, stolen products, or products that infringe on intellectual or industrial property rights.
- Engaging in spam, unsolicited mass communications, or unauthorised marketing activities.
- Manipulating the rating, review, or any reputation system of the Platform.
- Attempting unauthorised access to the Platform’s systems, servers, or data, or those of other users.
- Using the Platform for purposes other than those contemplated in these Terms.
- Impersonating another user or entity.
- Reverse-engineering, decompiling, or attempting to extract the source code of the Platform.
14. Suspension, Cancellation, and Account Deletion
The service provider reserves the right to suspend or cancel the account of any user who breaches these Terms, without prejudice to any legal action that may be warranted.
Users may request cancellation and deletion of their account at any time through the mechanisms provided in the Platform or by contacting the service provider at dalodev.dev@gmail.com.
Account deletion entails:
- The removal of the user’s personal data in accordance with the privacy policy and applicable data protection regulations.
- The deactivation of products listed by the seller, where applicable.
- The inability to recover data, content, or history associated with the deleted account.
Any orders in progress at the time of cancellation must be completed or cancelled by mutual agreement between the affected parties.
15. Limitation of Liability
In accordance with Articles 13 to 17 of the LSSI-CE, the service provider shall not be liable for:
- Content published by users, including product descriptions, images, and reviews.
- The quality, safety, legality, or suitability of products offered by sellers.
- The performance or non-performance of contractual obligations between buyers and sellers.
- Damages arising from transactions conducted between the parties outside the Platform.
- Temporary service interruptions due to maintenance, updates, or force majeure.
- Damages arising from improper use of the Platform by users.
The service provider undertakes to remove with the utmost diligence any content that is unlawful or contrary to these Terms, as soon as it has effective knowledge thereof, in accordance with Article 16 of the LSSI-CE.
16. Push Notifications NEW IN V1.1
The Platform may send push notifications to the user’s device to communicate relevant information, including but not limited to:
- Updates on order status (acceptance, shipment, delivery, etc.).
- New features and Platform updates.
- Promotional offers and product recommendations.
- Security alerts or changes to the Terms and Conditions.
Permission to receive push notifications is requested upon the first launch of the application or when a relevant feature requires it. Users may:
- Disable notifications at any time from the device settings or from the application’s internal settings.
- Manage notification preferences for the types of notifications they wish to receive, where such functionality is available.
Push notifications are not required for the use of the Platform. Disabling notifications will not affect access to or the operation of Artifex’s core features.
17. Modifications to the Terms
The service provider reserves the right to modify these Terms and Conditions at any time. Modifications will be communicated to users through the Platform or by email with a minimum advance notice of 30 calendar days before they take effect.
Where modifications substantially affect users’ rights or obligations, express acceptance of the updated Terms will be required to continue using the Platform.
Continued use of the Platform after the modifications take effect constitutes acceptance of the updated Terms.
18. Governing Law and Jurisdiction
These Terms and Conditions are governed by Spanish law.
For the resolution of any dispute arising from the interpretation or application of these Terms, the parties submit to the jurisdiction of the Courts and Tribunals of Parla (Madrid), Spain, unless consumer protection regulations establish a different jurisdiction under Article 90.2 of Royal Legislative Decree 1/2007 (LGDCU).
Users are informed that the European Commission provides an online dispute resolution platform, accessible at https://ec.europa.eu/consumers/odr.
